What is personal assistance and LSS?
Personal assistance is a form of individually tailored support for people who, due to significant and long term functional impairments, need help with everyday life. It enables the individual to make many of the decisions about when, how and by whom the help is given- supporting greater self-determination, participation and freedom in one’s life.
In Sweden, the law known as LSS (Swedish: Lagen om stöd och service till vissa funktionshindrade) lays the foundation for a set of rights and support measures for people with extensive and permanent functional impairments.
Under LSS, individuals who meet the eligibility criteria may be granted support services including personal assistance, adapted living accomodation to their needs, daily activities and more.
The goal is to promote good living conditions, equal opportunities and full participation in society for people with disabilities.
Who has the right to receive personal assistance?
To qualify for personal assistance under the Swedish LSS law, two main criteria must be met:
- You must belong to one of the LSS eligibility groups (“personkrets”).
- You must need help with certain “basic needs.”
LSS defines three categories of disabilities.
You must belong to at least one of these groups to be considered for support. Official certificates or medical statements are usually required.
Group 1 ("Personkrets 1")
People with intellectual disabilities, autism or autism related conditions.
Group 2 ("Personkrets 2")
People with a significant and permanent impairment of intellectual functioning caused by a brain injury acquired in adulthood due to external trauma or physical illness.
Group 3 ("Personkrets 3")
People with other long term physical or mental impairments that are not related to normal ageing, and are extensive, and cause substantial difficulties in everyday life, leading to a significant need for support.
Basic Needs (“Grundläggande behov”)
To be granted personal assistance, you must need help with one or more of the legally defined basic needs. These needs must be hands-on, essential tasks in your daily life.
Personal hygiene
For example, if you need help with showering, using the toilet, or other intimate hygiene tasks, how often and how long this support is needed matters in the assessment.
Meals
Feeding is considered a basic need. Preparing or cooking food is not included here (it is considered an “other need” assessed separately).
Getting dressed and undressed
If you require physical assistance to put on or remove clothes and how much time this takes, is considered in the evaluation.
Communication
If you need support to understand or to make yourself understood by the people around you, this can qualify as a basic need.
